Trial Set For New Jersey Man Accused Of Killing 3-Year-Old Son

PHILADELPHIA (CBS) -- An October 3rd trial date is set for David Creato, the Haddon Township man charged with killing his three-year-old son.

David Creato turned down a deal that would have given him a 35 year sentence in exchange for a guilty plea in the murder of his three-year-old son Brendan.

"We've rejected their offer. We made no counteroffer, and we're going to go to trial," said defense attorney Richard Fuschino.

Judge John Kelley turned down several defense motions to suppress evidence -- including the videotaped statement Creato made to police the morning Brendan was found dead along the Cooper River. That video contained the moment police told him his son was dead.

Fuschino said the video shows a cooperative man trying to find his missing son.

"I find it really, really curious that someone who is trying to get out there and do everything he can to help is then accused of taking his own son's life," he said.

Prosecutors contended Creato killed his son to appease his 17-year-old girlfriend.
