Lynsay Fox's Lawyer On Gun Store: 'They Failed & The Gun Ended Up In The Hands Of Officer Fox's Murderer"

PHILADELPHIA (CBS) – On Talk Radio 1210 WPHT, Dom Giordano talked with Attorney Hope Freiwald and John Lowy from the Brady Campaign to Prevent Gun Violence about their lawsuit, filed on behalf of Lynsay Fox, against the gun store that sold the weapon used to kill her husband, a Plymouth Township police officer, to a straw purchaser.

Freiwald stated that In Sight Firearms of Norristown acted irresponsibly in selling the gun to a buyer they should have been able to identify as suspicious.

"We contend that they were negligent. We also contend that they acted intentionally and recklessly in making these sales because the red flags were there. They failed to do what they're supposed to do and as a result of that the gun went to the straw purchaser and ended in the hands of someone who murdered Officer Fox."

She said he was known to the store and would hand off the weapons directly outside the building.

"We know that he bought multiple guns within a short period of time, that he bought the same kind of guns, [and] that he paid for them in cash. There were many different things that could've been picked up on. At the time, he was in a rehab facility…The fact is, this is someone who came into In Sight over and over and over again with cash in hand, went out into their parking lot, transferred the gun to Thomas, who then used it as a crime gun."

Lowy commented that statistics indicates the majority of criminal gun sales come from the same dealers.

"There's a small number of gun dealers who are making conscious decisions to put their profits over public safety of their communities and those are the ones that are supplying the criminals."
