Police: Driver In Deadly Cape May County Crash Intoxicated

CAPE MAY COUNTY, N.J. (CBS) -- Investigators say a driver was intoxicated when he struck and killed two teenagers in Cape May County Tuesday evening.

Joshua Malmgren is facing several charges including driving while intoxicated for his alleged role in the deadly accident that occurred at about 9:15 p.m. on Bayshore Road in the Green Creek section of Middle Township.

According to investigators, Malmgren was driving in the eastbound lanes of Bayshore Road when he veered into the shoulder and struck two juvenile females.

Nioami Lazicki, 15, and Ashley Dauber, 13, were pronounced at the scene. A third female in the group, Nioami's sister, was not injured.

"She suddenly had an urge to turn over her shoulder and she'd seen the headlights and got out of the way," said Bill Gaston, Nioami's father. "By the time she screamed, this guy was right on top of them."

Family members and friends left flowers and momentos where the girls died.

"It's crazy, my best friend's dead because someone can't obey the law," said Emmy Sanchez.

Investigators say Malmgren stayed at the scene and was arrested by arriving officers.

Malmgren has been charged with two counts of Death by vehicular homicide, a crime of the second degree, driving while intoxicated, reckless driving, failure to maintain a lane of travel and consumption of alcoholic beverage by an operator of a motor vehicle.

He is being held on $50,000 cash bail at the Cape May County Correctional Center.
