Deptford Woman Sentenced To Five Years In Prison For Drunk Driving Death Of Bicyclist

GLOUCESTER COUNTY, Nj. (CBS) -- Gloucester County Superior Court Judge Walter Marshall, Junior sentenced a Deptford, New Jersey woman to five years in prison on Thursday for the drunk driving death of bicyclist a year and a half ago.

42-year-old Mary Dalton's blood alcohol level was three times the legal limit when she struck 43-year-old Thomas McCoy of Woodbury, New Jersey, who was riding his bicycle on the shoulder of Delsea Drive.

She admitted to leaving the scene, only to see her truck break down about a mile up the road.

"Based on what the law allows us to get in a case of this sort, five years is reasonable," said Assistant Gloucester County Prosecutor Mary Anton. "I think that the penalties should probably be higher for something like this."

Dalton was credited for time served since her arrest in September of 2010.

She addressed McCoy's family in court, saying she lives with the pain of what she did every day, but added "it doesn't compare to the pain I caused them."
