Decision Day For Convicted Cop Killer Eric Floyd
Eric Floyd, 35, convicted of the first-degree murder of Philadelphia police sergeant Stephen Liczbinski, was expected to decide by Monday morning whether he would testify before the jury considering whether he will be sentenced to death or life in prison.
KYW's Tony Hanson reports Floyd (above), who was removed from the courtroom after punching his attorney during jury selection, has been given repeated opportunities to return to the court since then, but has repeatedly declined.
He did testify during the trial, but it was cut short when he failed to answer questions from the lawyers.
If Floyd does not testify, attorneys for Levon Warner are expected to begin presenting their evidence and argument contending Warner is mentally challenged, suffered brain damage from boxing, and that this non-shooter's life should be spared. He should be sentenced to life in prison.
