Another Setback For Bill Cosby's Defense Team As They Fight Sex Assault Charges
PHILADELPHIA (CBS) -- Another blow dealt to Bill Cosby in his fight against sex assault charges in Montgomery County.
Judge Steven O'Neill denied two motions from Bill Cosby's defense team.
One argued charges against the 79-year-old should be tossed, claiming the 11-year delay between the allegations and the filing of charges violated Cosby's due process rights.
The defense claims prosecutors gained numerous advantages, including fading eyesight that they say prevents Cosby from participating in his own defense.
Prosecutors say they didn't have access to the potentially incriminating deposition because Cosby worked hard for many years to keep it under seal.
Judge O'Neill also denied a defense motion asking for a competency hearing or an in-chambers interview of the 13 women with similar claims who prosecutors are requesting to present at trial.
Whether or not they can put those witnesses on the stand at trial will be the topic of a hearing next month.
