Nearing Trial, Kane Asks PA Supreme Court To Throw Out Charges

PHILADELPHIA (CBS) - Pennsylvania Attorney General Kathleen Kane has filed an 11th-hour appeal to the Pennsylvania Supreme Court in an effort to get perjury and obstruction charges against her thrown away.

In a response filed Wednesday, prosecutors call the move "a thinly veiled attempt to stall the wheels of justice."

With jury selection set to begin this coming Monday, Kathleen Kane's attorneys filed the emergency petition asking the Pennsylvania Supreme Court to throw out charges against her, and to put a halt to the trial while they consider her request.

Her attorneys argue the use of a special prosecutor to investigate alleged grand jury leaks was unconstitutional. The state Supreme Court ruled against Kane on the same issue last year.

Prosecutors call the move an attempt by Kane to avoid the public determination of her guilt, adding this is a matter that "must be resolved so the cloud hanging over the attorney general's office can be removed."
