Family Of Businessman Killed In Phila. Train Crash Files Lawsuit

PHILADELPHIA (CBS) -- The first wrongful-death lawsuit was filed Monday stemming from the crash of Amtrak train 188 in Philadelphia's Port Richmond neighborhood.

The family of Maryland businessman Bob Gildersleeve is suing Amtrak, claiming "negligence and outrageous conduct."

Gildersleeve was headed to New York on the evening of May 12th, when the train derailed.

The family's attorney spoke with CBS 3 Eyewitness News.

"This has been a horrible continuing to unfold nightmare for this family. Two teenage children, a loving, devoting, caring wife who have just lost everything that meant everything in the world to them," said attorney Tom Kline.

The 45-year-old was one of eight people killed in the crash.

Amtrak has not commented on the lawsuit.
