Norristown Gun Dealer Thinks Lawsuit Over Cop Killing is Harassment

NORRISTOWN, Pa. (CBS) -- Lawyers for the widow of murdered Plymouth Township, Pa. police officer Brad Fox were in Montgomery County Court today for a hearing on preliminary objections in the civil trial against the gun shop that sold the weapon used in Fox's murder.

The civil suit alleges that In Site Firearms should have been able to recognize that Michael Henry was lying when he filled out the application to buy the gun that was later used by Andrew Thomas in 2012 to kill Officer Fox.

The Brady Center is representing Fox's widow pro bono, filing the suit not only against retired police officer Luke Kelly, the owner of In Site, but also against a former business associate, William Gordon, whom plaintiffs allege was still involved in the company.

"They've now filed suit against everybody they can think of, because they want to put gun dealers out of business," says Gordon's personal attorney, Michael Gottlieb.  He says the Brady Center is only including his client to punish him for being a legal gun dealer –- adding that Gordon was retired and out of the business in 2011.

In court, Judge Thomas Branca told lawyers from the Brady Center to stick to facts, adding he won't allow them to "use this court to push a social agenda."  Those lawyers declined comment.
