Montco Man Will Serve Prison Time For Aiming Crossbow at Passersby

NORRISTOWN, Pa. (CBS) -- A man who was in his underwear when he pointed a crossbow at the head of man driving along a Souderton street was sentenced today to at least 1½ years in prison.

Wayne Kopack's lawyer, Sara Webster, had asked for work release, arguing that her client has changed since the day last March when he stepped off a sidewalk in Souderton, Pa., wearing only a t-shirt, boxer shorts, and work boots, and pointed a crossbow at the head of a man driving along Noble Street.

"This event occurred in March and his daughter was born in April," Webster notes.  "And since then (he has been) going to AA, going to treatment.  He's always been a hard worker.  I think he will turn his life around."

But Montgomery County judge William Carpenter agreed with the prosecution that Kopack's violent criminal history called for the standard sentence.

Kopack had not been wearing pants at the time of the incident because, he admitted, he had urinated in them after leaving a bar.  He has acknowledged he has an alcohol problem and is undergoing treatment.

Kopack's lawyer says her client was carrying the crossbow, which was broken and not loaded, because he feared someone from the bar was coming after him.

The couple in the SUV was out looking for their lost dog.  And when Kopack saw the slow-moving vehicle, Webster says, he raised the crossbow in fear for his safety.
