Dick Morris First To Speak With Congressman Jim Gerlach About New Piece Of Legislature

PHILADELPHIA (CBS)--Those tuned into Wednesday afternoon's Dick Morris Program with Gary R'nel heard Dick's frustration with Congress' inability to curb President Obama from using Executive Orders.

Congressman Jim Gerlach (PA-6th District), motivated by the testimony of Jonathan Turley of George Washington University to the House Judiciary Committee last year, has introduced the H.R. 3857 - Enforce the Take Care Clause Act of 2014. The "Take Care Clause" of the Constitution requires a president to faithfully execute all laws.

During his interview with Dick Morris Congressman Gerlach says,"In the past few years there have been a number of cases sited  where the President is not fully executing all laws, so I came up with this legislation to give Congress standing to raise that kind of issue before the Federal courts."

As a result of legislation, the Federal Court would have the ability to determine if any violations have been made and have an expedited method to send the issues to the Supreme Court to undertake injunctive relief.

Congressman Gerlach explains that his hope for the legislation is to move from a uber-Presidency of unchecked powers to  "balance between Congress which enacts and send the language of the legislation to the President and the President signs it into law - maintaining that balance; and I think this bill does that."

Congressman Jim Gerlach has announced that he's not running for re-election in 2014 and has been outspoken on issues such as President Obama's Executive Power Grab.
