Alleged DUI Crash Involving Off-Duty Philadelphia Cop Under Investigation

PHILADELPHIA (CBS) -- The Philadelphia District Attorney's Office is now investigating a car crash from last weekend involving an off-duty Philadelphia police officer and a Fishtown man who died.

The family of 55-year-old David Farries is now grieving his death. He lost his life Tuesday after getting seriously hurt in a two-car crash late Saturday night in Northeast Philadelphia.

The crash took place at the intersection of Ashburner Street and State Road when an off-duty Philadelphia police sergeant allegedly struck the side of an eastbound van on Ashburner Street.

Now the District Attorney's Office is investigating the 54-year-old police officer and whether he was under the influence. As for the family's criticism that the case is being differently because an officer is involved, First Assistant District Attorney Ed McCann says that's not happening.

"We're not going to make a charging decision until we have all the facts and we can determine what the appropriate charges are. I completely understand when someone's dealing with a loss they want immediate action," McCann said.

McCann says the police department is fully cooperating with them as they put the pieces together. The officer was also hurt in the crash but with non-life threatening injuries.
