Fumo's Health At Issue During Resentencing Hearing

PHILADELPHIA (CBS) -- The re-sentencing hearing of convicted former Pennsylvania state senator Vincent Fumo will continue into a second day tomorrow. Closing arguments are expected.

During the hearing the Prosecution accused the defense of grandstanding when a photo taken by Fumo's fiancé of all his prescription medication after the former senator was in prison was presented. Carolyn Zinni told the court she gathered all the bottles and thats when she realized Vince Fumo's addition.

prosecutors challendged Fumo's self reported addiction to prescription drugs and alcholol and his enrollment in a prison drug program with a time reduction credit.

Among the witnesses testifying was Dr. John Manenti with the bureau of corrections. He disclosed Fumo's health history and treatments. Fumo was diagnosed with a number of heath issues including renal disease, diabetes, anemia, anxiety and depression. (see previous story).

Fumo was dressed in dark green prison jumpsuit and has grown a full, white beard. (Cameras are not permitted in federal courtrooms.)

The defense wants the same 55-month sentence, while prosecutors seek a sentence of about 20 years.

It is unclear when the judge will make his decision.
