Easton Area School District Appeals 'Boobies' Bracelet Court Ruling

EASTON, Pa. (AP) -- An eastern Pennsylvania school district has appealed a judge's ruling that prevents the school from banning breast cancer fundraising bracelets that say "I (heart) boobies!"

WFMZ-TV reports that the Easton Area School District on Friday filed an appeal of U.S. District Judge Mary McLaughlin's April 12 ruling.

Mary Catherine Roper tells the Express-Times of Easton that the district has not filed a request to stay the judge's order during the appeal. She says that means students can still wear the bracelets while the court considers the issue.

In her ruling, McLaughlin said the district cannot ban the rubber jewelry because it is not lewd, vulgar or distracting to the school day. That ruling came after two middle school students who had been suspended for wearing the bracelets filed a free-speech lawsuit against the district in November.
