Same-Sex Marriage Laws
The proposed settlement would essentially move the anniversary date for the twenty-three couples still part of the case to May 20, 2014 — the same date a federal court found Pennsylvania’s ban on same-sex marriage unconstitutional.
The case involves two women who were legally married in 2005, when they lived in Massachusetts. But when they moved to Pennsylvania in 2009, their marriage was not recognized under state law.
Garden State Equality attorney Lawrence Lustberg says the problem stems from how federal benefits are doled out.
As of Monday, any couple married in another state or country which recognizes same-sex marriage will now be recognized as married in Delaware.
