Playboy Playmate Could Face Charges For Body-Shaming Snapchat Post
PHILADELPHIA (CBS) -- Internet outrage may turn into criminal charges for a Playboy Playmate who Snapchatted a photo of an unsuspecting naked woman in a gym locker room.
2015 Playboy Playmate of the Year Dani Mathers faced widespread criticism on social media after she shared a photo of a naked women in a gym locker room on Snapchat in July with the caption "If I can't unsee this, then you can't either."
The gym reported the posting to police and revoked her membership.
Now, the alleged victim has come forward and the case has been handed over to the Los Angeles city attorney's office.
Internet Law Attorney Richard Peirce says if charges are filed it's likely going to under some form of invasion of privacy.
"In essence, breaching the expectation of privacy they have in a certain setting, all of them might be criminal," he said, "but one or more might increase the penalty, whether it be jail time or fine."
Mathers has apologized, saying she meant to send the photo as a private message and not to her public followers.
"Whether you share it with one person or whether you share it with thousands of people, that might only go towards the nature of the damages maybe, but ultimately if the law prohibits not only the capturing of someone in a private situation like that, but then the distribution, then the amount of people it's distributed to might ultimately be irrelevant."
TMZ reports the woman in the post -- who is in her 70's -- is willing to testify, but no charges have been filed against Mathers.
