Court Fight Over Planned Charity Concert At Jersey Shore

WILDWOOD, NJ (CBS) -- Plans for a charity concert on the beach in Wildwood next month are being fought in court by the people who own popular amusement piers in the shore town.

Morey's Piers is asking a Superior Court judge to stop two days of music just south of the convention center, and BeachGlow: Concerts for Charity president Gerard Kunkel is incensed by the court action.

"We're not clear as to the motivation but we're being charged with private nuisance for our 2014 event," Kunkel told KYW Newsradio. That event was a concert on the Wildwood beach where some 20 foul words came out of the mouths of performers.

Morey's, in a statement, is expressing concern over Electronic Dance Music performers, saying the musical genre is becoming "increasingly known for drug and alcohol-fueled behavior that has resulted in overdoses and deaths, as well as profane language" and has "no role in our family resort setting."

Kunkel concedes the language was an issue back then, but insists "You can't control what a human being is going to say at the moment. But we do have the provision to cut the microphone if it happens and not give that microphone back to that individual again." That provision has been written into every performer's contract.

Morey's also suggests the City of Wildwood made a commitment after the 2014 show not to allow a repeat performance, a commitment they say the city is now violating by issuing permits for the show.

They insist BeachGlow was warned about a court fight, but went ahead with its plan anyway.

Superior Court Judge Nelson Johnson is set to hold a hearing on the issue Monday.

As for the concert, which at this moment is still on for July 8th and 9th just south of the Convention Center, tickets will be available on site or can be purchased on line at www.beachglow.org.

Proceeds from the event are set to go to Little Kids Rock, a national non-profit that promotes music education in schools.
