School District Tries To Re-argue Ruling That Could Cost It Millions

By Mike DeNardo

PHILADELPHIA (CBS) -- A legal "Hail Mary" by the Philadelphia School District has failed before the Pennsylvania Supreme Court.

The state supreme court is refusing to reconsider its February ruling that said the School Reform Commission did not have the extraordinary powers it thought it had under the state takeover law.

The SRC asked the court to take another look at the case, saying the ruling could be financially devastating. But the high court in a one-line order yesterday, denied the request.

The district had used those powers over the last several years to limit charter school growth, close schools sooner and cancel parts of the teachers contract. The SRC argued that the ruling could be "catastrophic" if it means the district would to pay for unlimited charter growth.

A spokesman says the district was not prepared to comment on the high court's denial.
