Kane's Request To Have Judge From Outside Montco Handle Her Criminal Case Denied

NORRISTOWN, Pa. (CBS)  -- A Montgomery County judge has denied attorney general Kathleen Kane's request that a judge be brought in from another county to hear her criminal trial.

Kane is charged with leaking secret grand jury information and then lying under oath to cover it up.

Kathleen Kane's attorneys filed a motion asking the entire Montgomery County Court of Common Pleas bench should be recused, saying three of the 22 judges on the bench have ties to the investigation and what they call "a clear interest in the outcome" of the case.

The defense points to Judge Risa Ferman who was district attorney during the investigation into criminal charges, Judge William Carpenter who oversaw the grand jury, and Judge Carolyn Carluccio whose husband was appointed special prosecutor by Judge Carpenter.

But prosecutors countered by saying none of those judges are hearing the case, and the judge that is, Wendy Demchick Alloy has no conflict of interest.

Judge Demchick Alloy sided with prosecutors and denied the motion.
