Decision By Chester County DA's Office On Whether To Re-Try Man For Murder In Death Of Father

WEST CHESTER, Pa. (CBS) -- According to paperwork, the Chester County District Attorney's office is going to re-try an Exton man on murder charges in the death of his 92-year-old father.
Edward O'Brien III is charged with third degree murder, involuntary manslaughter, aggravated assault, and reckless endangerment as prosecutors allege he denied his 92-year-old father medical care and medication that could have saved his life.
O'Brien's attorney argues the father refused medical care, didn't want to go to a nursing home, and the son was only following the father's wishes.
Charges were filed after the elder O'Brien's body was found with bedsores in a room with feces on the furniture and the rug.
A trial last month ended with a deadlocked jury following a week and a half of testimony, and nine hours of deliberations.
A new trial is scheduled for June 17th. Because of a gag-order, lawyers are prohibited from talking about the case.
