Case Against AG Kane's Driver Will Go To Trial After Judge Dismisses Series Of Pre-Trial Motions

NORRISTOWN, Pa. (CBS) -- The attorney for a member of Kathleen Kane's security detail was in court today, arguing charges against his client, Patrick Reese, should be dropped.

Before the hearing, Montgomery County Judge William Carpenter said in the interest of full disclosure, his house was under surveillance and his wife had been followed while driving his car. Judge Carpenter, who oversaw the grand jury investigating Kane said he did not attribute it Patrick Reese, but felt the defense should know.

Judge Carpenter dismissed three motions from the defense, one requesting he recuse himself, as his name was among the alleged search terms.

Reese is charged with violating of a protective order by searching an email database looking for information on the grand jury investigating Kathleen Kane.

But his attorney argued Reese was never served with that order. Judge Carpenter also dismissed that motion siding with prosecutor Thomas McGoldrick, who argued it's an issue for trial:

"And as I stated in court, we understand the elements of the offense and we believe we'll be able to meet our burden at trial."

The trial is set to begin in December.
