Sources: Cosby Under Investigation In Alleged 2004 Sexual Assault

By Walt Hunter

PHILADELPHIA (CBS) -- As reported first and exclusively on CBS 3 Eyewitness News, sources now confirm to Investigative Reporter Walt Hunter that Bill Cosby is under criminal investigation in Montgomery County in an alleged 2004 sexual assault in Cheltenham Township.

District Attorney Risa Vetri Ferman has consistently declined comment.

However, CBS 3 has confirmed the investigation was triggered last summer by the release of depositions in a civil case which had previously been sealed.

Depending on the outcome of the criminal investigation, sources say, at some point in the future Cosby could face criminal charges.

Meanwhile, in New York City, Donna Barrett, a track official, told reporters gathered at a press conference with her attorney, and a second woman who claims she was assaulted by Cosby, that she was assaulted by Cosby at Franklin Field during the 2004 Penn Relays at Franklin Field.

Barrett claims she was posing for a picture with teammates when Cosby grabbed her in a "vice-like grip", pulling her toward him and rubbing against her.

Cosby has not been charged with any criminal wrongdoing in connection with any allegations made against him.

Contacted by CBS 3, his attorneys in Philadelphia and Los Angeles did not immediately respond to requests for comment.
