New Information About Germantown Kidnap Suspect's Prior History

PHILADELPHIA (CBS) -- Almost nine years to the day before Delvin Barnes allegedly dragged 22-year-old Carlesha Gaither off a Germantown street, holding her captive for three days, court documents show he faces a long list of charges for vicious attacks on his former wife in Philadelphia, along with her mother and father, who were are calling "Anthony" to protect his daughter's identity.

"Most of the time you can tell if this person is okay, or not okay, and that's what I got from him, something's not right with him," he stated.

Fearing violence from Barnes, all three family members got protection orders from the court, but records show, they couldn't stop Barnes as he first attacked his daughter in a violent home invasion.

Court documents revealing "the defendant engaged in forcible sexual intercourse…jumping on top of her, hitting her in the face, choking her…placing the comforter over her face..demanding sex..telling her he would stop beating her if she removed her clothes."

For his crimes, records show, Barnes served the maximum on a four to eight year sentence, released on probation in November, 2013.

"What about the '3 strikes you're out' thing?" Anthony asked. "I mean, he got a lot of strikes. What is he still doing walking around the streets?"

The father added, he believes if Barnes had received a tougher sentence, Carlesha and a second woman in Virginia he's accused of trying to murder, might have been spared.

"If he had got the time that he was supposed to have got with my daughter," he concluded. "This wouldn't have happened to the other two young ladies."
