Judge Postpones Decision On Paterno Family Lawsuit

BELLEFONTE, Pa. (AP) — A Pennsylvania judge plans to issue a written opinion about whether a lawsuit filed by the family of longtime Penn State football coach Joe Paterno against the NCAA should be allowed to go forward.

After a 3½-hour argument session Tuesday in Bellefonte, Pa., Judge John B. Leete did not say when he planned to rule.

College sports' governing body is asking the court to throw out the lawsuit.

Leete is considering a host of issues, including whether Penn State itself is an indispensable party to the lawsuit, which challenges the NCAA penalties imposed on the university as a result of the Jerry Sandusky child molestation scandal.

The Paterno family and other plaintiffs allege breach of contract, contract interference, defamation, civil conspiracy and commercial disparagement.
