PHILADELPHIA (CBS) — The Phillies now have problems on the field and off: The Phillie Phanatic has been sued.
Suzanne Pierce says she was lounging by the pool at Avalon’s Golden Inn in July 2010 when the Phillie Phanatic burst onto the scene. And when the Phanatic makes an appearance, you can expect plenty of hijinks, but Pierce, of Abington, says the fun-loving mascot went too far.
“She was seated in a chair, and suddenly, the Phanatic came up and picked her up in her chair and threw her in the pool,” says Pierce’s attorney Aaron Denker.
Denker says Pierce, who is in her mid-30s, fell awkwardly into the water and was severely injured. She now walks with a cane.
“She’s got herniations at various levels of her back,” Denker explains.
No dollar amounts have been mentioned, but Pierce is going after everyone who puts on the Phanatic costume. A Phillies spokeswoman says they’re aware of the suit and don’t believe the Phanatic engaged in wrongful conduct.
This is at least the fourth time the Phanatic has been sued.
