Plea Deal Reached In Deadly Northeast Philadelphia Crash

PHILADELPHIA (CBS) — A plea deal has been reached in the case of a 14-year-old boy who took his mother’s car in the middle of the night and then crashed, killing a man in another car.

The prosecution and defense have agreed the case will be handled in juvenile court.

Prosecutor Beth McCaffery says defendant Winston Charleston has agreed to admit to the charges in juvenile court. Charleston will be Adjudicated delinquent and held for four years, the maximum term, and remain under court supervision until he turns 21.

Authorities say Charleston was speeding from police — at speeds up to 85 mph — when his car slammed into another, killing 22-year-old Daniel Foreacre and seriously injuring his girlfriend.

The fatal crash happened about 2 a.m. on June 28th near the intersection of Academy and Willits Roads in Northeast Philadelphia.

The victim’s family reluctantly accepted the result. His mother, Karen, was in tears.

“We couldn’t get anything better than this, obviously because of his age. He will, I am sure, cause problems where he is at and he will get his due. And it can’t bring my son back.”

Two young friends in the car with Charleston were also seriously injured.
