No Bail For Alleged Mobster Nicky Scarfo Jr.

CAMDEN, NJ (CBS) - A federal judge in Camden has determined that alleged mob member Nicky Scarfo Jr. should be detained on a 25-count indictment contending he led an effort involving a dozen others to bleed a Texas-based mortgage company out of $12-million.

Assistant US Attorney Steven D'Aguanno countered with a 40-page brief, suggesting the fact Scarfo could face more than 30 years in prison if convicted in the draining of $12-million from FirstPlus Financial Group of Texas would be motivation enough to flee. And his continued contacts with the mob suggest he's a public danger.

Judge Anne Marie Donio agreed with that argument. Donio deemed Scarfo was a danger to the community. Most of his co-defendants have been granted bail, including his wife.

Defense attorney Mike Riley argued there's no proof his client is tied to the mob and he's being pursued because of what Riley termed "the deeds of the father," referring to "Little Nicky" Scarfo, who's doing life behind bars for his mob activities in the past. Riley argued for some form of bail paired with home confinement, noting Scarfo's never failed to show up for court before.

This case is scheduled to go to trial in January, but most believe that schedule might be overly optimistic.
