Phila. Jury to Decide Life or Death for Convicted Cop Killers

Life in prison or death.

The penalty phase begins Monday for convicted cop killers Eric Floyd and Levon Warner.

KYW's Tony Hanson reports that the prosecution is seeking the death penalty.

Last week a Philadelphia jury found that the defendants, Eric Floyd and Levon Warner, shared the intent to kill sergeant Stephen Liczbinski with triggerman Howard Cain, who was later shot and killed by police.

Now that same jury will have to weigh so-called "aggravating" and "mitigating" factors.

Prosecutor Jude Conroy was expected to present evidence and arguments for several aggravating factors -- including the murder of a police officer, a murder during a robbery, and the fact that both defendants have significant histories of crimes of violence.

Warner's attorneys were expected to argue in part that he is mentally challenged -- that he suffered head injuries from boxing -- and is a "follower."

Floyd, who slugged his other attorney during jury selection and has declined to be present for virtually all of the trial (see previous story), expressed remorse in a confession to police.  That statement was read to the jury during the trial.
