Jury Begins Deliberations in 2008 Murder of Police Sergeant

A Philadelphia jury has been instructed in the law and is now deliberating the fate of two men charged with the murder of Philadelphia police sergeant Stephen Liczbinski in May of 2008.

KYW's Tony Hanson reports from the Criminal Justice Center that the prosecution is seeking a first-degree murder conviction and the death penalty.  Defense attorneys are hoping to have the lives of their clients spared.

Authorities concede that the actual triggerman, Howard Cain, is dead -- shot and killed by officers soon after the murder of Sgt. Liczbinski.

But the prosecution contends that defendants Eric Floyd and Levon Warner shared the intent to kill.

As the adage goes, in for a penny, in for a pound.  They were in on the robbery, prosecutors say, so that puts them in on the shooting and murder.

The defense concedes they were in on the robbery. But Floyd's attorney told the jury he's guilty of second-degree murder, not first.

And Warner's attorney argued that his client is not guilty of murder  even though he was in on the robbery that led to the pursuit and shooting of  Liczbinski.
